Quotations, contracts, and order terms are confirmed in writing before supply.
Cold-chain, certification, and customs responsibilities are defined upfront.
Pricing, quality standards, and grower partnerships follow published policies.
These terms are subject to Kenyan law unless otherwise agreed in B2B contracts.
These Terms & Conditions (“Terms”) govern your access to and use of the Safari Herbs & Spices website, your purchase of our herbs and spices, and any wholesale, export, or partnership relationship with us. Please read them carefully before placing an order or entering into a supply agreement.
1. Introduction & acceptance
By accessing this website, submitting an enquiry, placing an order, or entering into a written supply agreement with Safari Herbs & Spices (“Safari Herbs”, “we”, “us”, or “our”), you (“you”, “Customer”, or “Buyer”) agree to be bound by these Terms.
If you do not agree, you must not use our website or services. If you are entering into these Terms on behalf of a company or organisation, you represent that you have authority to bind that entity.
Written contracts prevail. Where a signed quotation, purchase order acceptance, or supply agreement conflicts with these website Terms, the signed document takes precedence for that specific transaction.

3. Website use & acceptable conduct
You may use our website for lawful purposes only. You agree not to:
- Use the site in any way that breaches applicable local, national, or international law;
- Attempt unauthorised access to our systems, servers, or data;
- Introduce viruses, malware, or other harmful code;
- Scrape, harvest, or systematically copy content without written permission;
- Impersonate Safari Herbs, our staff, or other users;
- Submit false, misleading, or fraudulent enquiries or orders.
We reserve the right to suspend or restrict access to the website where we reasonably believe these Terms have been violated or where necessary to protect our systems and users.
3.1 Accuracy of website information
Product descriptions, imagery, certifications, and availability on this website are provided for general information. While we strive for accuracy, they do not constitute a binding offer until confirmed in a written quotation or order acceptance.
4. Products & descriptions
Safari Herbs offers a catalogue of premium organic herbs and spices, including but not limited to Winter Thyme, Lemon Thyme, Rosemary, Basil, Mint, Chives, Coriander, Sage, Marjoram, and our spice line. Product specifications—including cultivar, cut, pack size, shelf life, and organic status—are confirmed per order.
- Product images are representative; natural variation in colour, size, and form may occur between harvests;
- We may discontinue or substitute cultivars where agronomic or supply conditions require, with prior notice to contracted buyers;
- Minimum order quantities, pack formats, and lead times vary by product and destination market;
- All products are intended for food use unless otherwise specified in writing.
5. Orders, quotations & contracts
5.1 Enquiries & quotations
Submitting a contact form or email enquiry does not create a binding contract. We will respond with a quotation or proposal outlining product, volume, price, incoterms, delivery window, and certification documentation where applicable.
5.2 Order acceptance
A contract is formed when we issue written order confirmation or you accept our quotation in writing (email acceptance is sufficient). We reserve the right to decline or cancel orders at our discretion, including where:
- Products are unavailable due to harvest, weather, or supply constraints;
- Credit checks or buyer verification are unsatisfactory;
- Export licences, phytosanitary certificates, or import requirements cannot be met;
- We suspect fraud or breach of these Terms.
5.3 Wholesale & long-term supply agreements
Repeat buyers and export partners may enter separate framework or multi-season agreements. Such agreements may specify volume tiers, pricing formulas, exclusivity, private labelling, and service levels. Where a framework agreement exists, it supplements these Terms.
6. Pricing & payment
Prices are quoted in the currency specified in your quotation (typically USD, EUR, GBP, or KES). Unless stated otherwise, quoted prices:
- Exclude import duties, taxes, customs charges, and inland freight in the destination country;
- Are valid for the period stated on the quotation (typically 14–30 days);
- May be revised for orders placed after quotation expiry due to input costs, freight, or exchange-rate movement.
| Payment term | Typical application |
|---|---|
| Advance / proforma | First orders, custom packs, or new export buyers |
| Net 30 days | Approved recurring wholesale accounts |
| Letter of credit | Large export shipments where agreed in contract |
| Cash on delivery | Selected domestic Kenya orders only |
Late payments may incur interest at the rate permitted under Kenyan law and may result in suspension of further shipments. You are responsible for all bank charges on your side of the transfer unless otherwise agreed.
7. Delivery, cold-chain & risk
Fresh herb shipments require temperature-controlled handling from harvest through dispatch. Delivery terms (Incoterms® 2020) are specified in each quotation—commonly EXW Naromoru, FOB Mombasa, CIF destination port, or DAP buyer premises where logistics allow.
- Our responsibility — maintaining cold-chain integrity until the point defined in the agreed Incoterm;
- Your responsibility — timely import clearance, refrigerated receipt, and onward cold storage from the agreed delivery point;
- Delivery windows — are estimates; delays caused by weather, customs, carrier disruption, or force majeure are not grounds for cancellation unless material breach occurs;
- Inspection on receipt — you must inspect goods promptly on arrival and notify us of visible damage or temperature breach within 24 hours (48 hours for international air freight).
Risk of loss passes in accordance with the agreed Incoterm. Title passes upon full payment unless otherwise stated in your supply agreement.
8. Export, import & customs
Export from Kenya and import into your destination country are subject to applicable regulations. Safari Herbs will provide standard export documentation including:
- Commercial invoice and packing list;
- Phytosanitary certificate (where required);
- Certificate of origin;
- Organic and food-safety certification copies (Organic, KEPHIS, Global G.A.P., HCDA as applicable);
- Batch traceability records upon request.
You are responsible for obtaining import permits, paying customs duties and VAT/GST, and ensuring products meet your local regulatory requirements. We are not liable for seizure, rejection, or delay caused by incomplete import documentation on the buyer side.
9. Quality, certification & food safety
Safari Herbs maintains quality management aligned with organic certification and export food-safety standards. Products are graded, packed, and dispatched according to agreed specifications.
9.1 Quality claims
If you believe a shipment does not meet agreed specifications, you must notify us in writing within the inspection period stated in Section 7, providing batch references, photographs, and temperature logs where relevant. We will investigate and, where a valid claim is confirmed, offer replacement, credit, or refund at our reasonable discretion.
9.2 Certification
Certification logos and documentation on our website and packs reflect current accreditation status. Certificates are renewed periodically; updated copies are available on request or via our certification page.
10. Samples, farm visits & audits
Sample shipments and farm visits may be arranged for qualified buyers. Sample terms (cost, freight, and volume limits) are confirmed per request. Farm visits require advance booking and compliance with our on-site health, safety, and biosecurity protocols.
Quality audits and buyer inspections are welcome by prior arrangement. Auditors must not interfere with harvest operations or compromise food-safety zones without authorisation.
11. Intellectual property
All content on this website—including text, photography, logos, product names, packaging design, and layout—is owned by Safari Herbs & Spices or licensed to us. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
“Safari Herbs”, our logo, and associated brand assets are protected. Unauthorised use of our trademarks or certification marks is prohibited and may result in legal action.
Private-label buyers receive limited licence to use agreed artwork on approved packaging only for the duration and scope of the relevant supply contract.
12. Confidentiality
Each party agrees to keep confidential any non-public commercial, technical, or pricing information received from the other in connection with enquiries, quotations, or supply agreements. This obligation survives termination for three (3) years, except for information that becomes public through no fault of the receiving party or that must be disclosed by law.
13. Warranties & disclaimers
We warrant that products supplied will conform to agreed specifications at the time of dispatch and will be handled in accordance with applicable food-safety requirements.
Except as expressly stated in a written supply agreement, our website and services are provided “as is”. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant uninterrupted website availability. Scheduled maintenance and events outside our control may temporarily affect access.
14. Limitation of liability
To the fullest extent permitted by Kenyan law and any applicable international convention:
- Safari Herbs shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or business interruption;
- Our total aggregate liability arising from any order or claim shall not exceed the amount paid by you for the specific products giving rise to the claim in the twelve (12) months preceding the event;
- We are not liable for delays or failures caused by force majeure, carrier actions, customs authorities, or your failure to meet import or storage obligations.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Safari Herbs & Spices, its directors, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms or a supply agreement;
- Your misuse of our website or products;
- Your failure to comply with import, labelling, or food-safety laws in your jurisdiction;
- Third-party claims related to your repackaging, processing, or resale of our products beyond agreed specifications.
16. Force majeure
Neither party shall be liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to: extreme weather, drought, pest outbreaks, crop failure, pandemic, war, civil unrest, government action, port closures, fuel shortages, power outages, or carrier disruption.
The affected party must notify the other promptly and use reasonable efforts to mitigate impact. If force majeure continues for more than sixty (60) days, either party may terminate the affected order or contract without penalty, except for payment obligations for goods already delivered.
17. Suspension & termination
We may suspend or terminate your access to our website or supply relationship if you:
- Materially breach these Terms or a supply agreement and fail to remedy within fourteen (14) days of written notice;
- Fail to pay amounts when due;
- Engage in conduct that harms our brand, growers, or food-safety reputation;
- Become insolvent or subject to administration proceedings.
Termination does not affect accrued rights, payment obligations, confidentiality, intellectual property, limitation of liability, or dispute resolution provisions.
18. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of your relationship with Safari Herbs. By using our website and services, you acknowledge that you have read and understood the Privacy Policy.
19. Governing law & disputes
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles.
19.1 Jurisdiction
Subject to any alternative dispute mechanism in a signed B2B contract, the courts of Kenya shall have exclusive jurisdiction over disputes arising from these Terms or website use.
19.2 Alternative dispute resolution
For wholesale and export contracts, parties may agree in writing to mediation or arbitration under the rules of the Nairobi Centre for International Arbitration (NCIA) or another mutually acceptable body before pursuing litigation.
20. General provisions
- Entire agreement — These Terms, together with accepted quotations and signed supply agreements, constitute the entire agreement regarding website use and standard supply unless otherwise stated;
- Severability — If any provision is found unenforceable, the remaining provisions remain in full force;
- Waiver — Failure to enforce a provision does not waive our right to enforce it later;
- Assignment — You may not assign your rights without our written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets;
- Notices — Formal notices must be sent to the contact details in Section 2 by email with confirmation of receipt or by registered post;
- Language — These Terms are written in English. In case of translation, the English version prevails.
21. Changes to these Terms
We may update these Terms to reflect changes in law, business practices, or website functionality. Material changes will be posted on this page with an updated effective date. Continued use of the website after changes are posted constitutes acceptance, except where further consent is required for active supply contracts.
For ongoing supply relationships, we will provide reasonable notice of material changes that affect your orders.
